Families of Ojuelegba trailer crash victims sue Lagos Government

Five family members of the victims of the trailer crash in Ojuelegba area of Lagos has filed a N10 billion suit against the Lagos state government.

The Lagos state Attorney General, the state public works corporation, Motor Vehicle Administration Agency was joined as defendants in the fundamental right suit which was filed before a Federal High Court in Lagos.

Other defendants are: The Attorney General of the Federation, Federal Ministry of Works, Federal Road Safety Commission and the driver and owner of the ill fated drucks, Wasiu Adeleke and Kilani Ojo Adeyanju.

While the applicants in the suit are: Umar Abdulwahab, Usman Sulaiman, Ismala maikankan ,lbrahim Ibrahim  and Umaru Sulaiman Umaru who are all family members of the victims.

It would be recalled that three people died last year September when a 20 feet container loaded with cement fell from a truck at Ojuelegba Bridge.

The suit was filed by Norrison I. Quakers (SAN) and Moyosore Onigbanjo (SAN) on behalf of the plaintiffs.

In an affidavit in support of the suit sworn to by a Lagos based business man, Umar Abdulwahab, the deponent averred that on September, 2, 2015, he received a call from the Yaba mainland hospital official informing him about the accident and the fatalities asking him to come to the hospital mortuary to identify the corpses of Abubaker Sule,Umaru Sulaiman and kamilu Umaru. 
     
The deponent further averred that he was in deep shock and pain when he saw the mangled and shattered bodies of the deceased persons which were crushed beyond recognition by the trailer that fell on their vehicle.
Abdulwahab also averred that an eye witness told him that at western Avenue, Ojuelegba , Surulere lagos about 12noon,a diesel trailer truck with registration number Lagos Epe 46 XK driven by one kilani ojo Adeyanju,fell off ojuelegba bridge onto two vehicles one of which was the car in which the deceased persons were traveling.

The applicants are seeking for a N10 billion damages against the respondents jointly and severally.

They also urge the court to declare that the death of the deceased persons is tantamount to heinous infractions by the respondents of the deceased persons right to life, personal and human dignity, good health and family harmony as guarantee by sections 33 and 34 of the 1999 constitution of the Federal Republic of Nigeria and articles 4,5,16 and 18 of the African charter on human and people’s right.

No date has been fixed yet for hearing in the suit.
