EFCC re-arraigned Fred Ajudua for allegedly defrauding former Chief of Army Staff, Lt Col Ishaya Bamaiyi

Lagos socialite Fred Ajudua has filed an application before a Lagos High Court in Ikeja seeking permission to travel abroad for urgent surgery.
Ajudua made the application after he was rearraigned by the Economic and Financial Crimes, EFCC on an amended $8.4million fraud allegation.
The matter which was initially before Justice Oluwatoyin Ipaye was later transferred to Justice Kudirat Jose after Ajudua's co-defendant, Olorunke Idowu Rosulu opted for seperate trial.
Rosulu has since been sentenced to ten years in prison over the allegation.
The EFCC in the amended 28 count charge alleged that Ajudua defrauded former Chief of Army Staff, Lt Col Ishaya Bamaiyi in 2004 at the Kirikiri Prisons.
Before the charges was read, Ajudua's lawyer, Mr. Norrison Quakers, SAN, informed the court of a pending application dated May 10 by his client seeking permission to attend to his ill health.
Mr. Quakers told the court that Ajudua is seriously ill and requires urgent surgery abroad to salvage his solitary kidney.
Responding to the Judge 's inquiry on why there was no response to the application, EFCC lawyer, Mr. Saiudu Atteh told the court that the commission planned to respond orally.
The judge however insisted that the response should be made in writing.
Ajudua later pleaded not guilty to the 28 count amended charge after it was read to him.
A mild drama played out in court when Ajudua's lawyer urged the trial judge to allow his client to continue on the earlier bail granted him by the Court of Appeal.
Mr. Atteh however opposed the application saying the matter was starting de-novo and as such the defendant needed to file fresh bail application.
Mr. Quakers countered the argument insisting that since the subject matter in the charge was the same, the bail granted to his client by the Court of Appeal should subsist.
Ruling on the matter, Justice Kudirat Jose insisted that Ajudua must file a formal bail application before the court.
The judge however noted that she would not remand Ajudua in prison custody.
" I am not going to remand the defendant but in the light of the amended charge, he must file a bail application before this court," she said.
Jose subsequently adjourned the matter till September 15, 20, 21 and 22 for trial.
