Court jailed housemaid and others for stealing boss money

A housemaid, Happiness Gabriel  and her step father Gabriel Igbang, have been sentenced to three and half years imprisonment by an Igbosere Magistrate's Court in Lagos.
They were sentenced by Magistrate Mrs A. T Omoyele after they pleaded guilty to a three count charge bordering on conspiracy, ‎stealing and receiving stolen property.
The prosecutor Sargent Cyricaus Osuji, while giving the facts of the case, told the Court that the first defendant sometime in the month of May 2016, was contracted by the complainant one Mrs Bolanle Ibukunoluwa through one Alhaja popularly known as Iya Dolapo, as a housemaid and the monthly salary agreed upon was seven thousand naira and was to be paid at the end of the year.
He said that the first defendant moved to the house of her mistress and on June 26, 2016, at about 5:30pm  the complainant went out and came back at about 8pm and discovered that her housemaid had absconded, she forced the gate opened and then discovered that her Lenovo phone valued twenty thousand naira, was stolen and that caught her attention, so she hurriedly went to her room and discovered that her money one million, one hundred and fifty thousand naira has also been stolen as well.
Sgt. Osuji also stated that " immediately the complainant saw that her money and phones were missing, she went to her neighbours place to enquire if they knew the where about of her housemaid and they said she just left before 8pm, so she went to report the matter at Central police station and the Police sung into action."
"The first defendant was later apprehended at Benin, Edo state where she ran to, after giving her step father the money she stole. Under interrogation, the second defendant denied receiving any money from the first defendant even her mother Mrs Joy James also denied that she was given money by the first defendant.
"After much interrogation the first defendant's mother and the second defendant admitted to have collected money from her so she took the police to the bush in Ogun state where a cash of three hundred thousands naira, was recovered and another sum of two hundred and fifty two thousand, five hundred naira was also recovered at another location in the bush at Ogun state." He said. 
The prosecutor further stated that when the first defendant was arrested the complainant's phone was found with her and the sum of twenty thousand naira, which she admitted was part of the money that was stolen adding that it was her boyfriend one Samuel that advised her to steal.
According to the facts, the first defendant admitted that she only stole the sum of six hundred thousand naira and her mother also admitted to have received five hundred thousand naira only which was handed over to her by the second defendant.
After the facts was read to the defendants, the Court asked them if they understood what was read and the duo answered yes and admitted to committing the offence.
Delivering her Judgement, Magistrate Omoyele found the first defendant guilty of conspiracy and stealing  ‎and consequently sentenced her to two and half years imprisonment without an option of fine. While her  step father was found guilty of the offence of receiving stolen property and was jailed one year without an option of fine.
Both sentences starting from the day of pronouncement.
Before the sentence was handed over to the duo, the magistrate asked them if they had anything to say, the first convict  who was not remorseful, said ‎she had nothing to say, while the second convict said the only mistake he made was that he didn't send her back to her employer with the money when she came to his house.
Earlier the convicts were arraigned before the Court on a three count charge bordering on conspiracy, stealing and receiving preferred against them by the police.
The prosecutor had alleged that on June 26, at about 8pm, the defendants committed the offences at 30, Massey Street Lagos Island.
The offences committed according to the prosecutor is punishable under sections 409, 285 and 326 of the criminal laws of Lagos state 2011.
