Court strikes out Azibola's suit against EFCC

A Lagos high Court in Igbosere has strikes out a motion filed against the Economic and Financial Commission (EFCC),  by Azibola Robert, who is a cousin of former president Goodluck Jonathan. He is asking the court to restrain the Commission from arresting, detaining or investigating him.
The motion was struck out by Justice Candid Johnson on grounds of lack of diligent prosecution.
Azibola is being investigated by the EFCC for suspicious contracts awarded to him by the former National Security Adviser to former President, Goodluck Jonathan.
In the motion, Azibola is asking for an order nullifying and setting aside the remand order obtained by the EFCC to remand  him, an order directing the Commission to release him from custody.
He is also asking for an order of perpetual injunction restraining the EFCC or any person whatsoever acting for/on behalf of the Commission from arresting or detaining him and demand of special damages in the sum of N200, 000,000 (Two Hundred Million Naira Only).
EFCC investigation revealed that between 2012 and 2015, Colonel Sambo Dasuki allegedly awarded fictitious contracts to the tunes of N2.2 billion  $1.6 billion dollars and €9,905,477.00 respectively to Azibola and his companies and proxies.
Also the sums of $40 million and N650 million was said to have been traced in the bank account of Azibola as moneies paid by the former NSA.
It would be recalled that Azibola had also made similar motion before Abuja High Court and same was dismissed by Honourable Justice O.O Goodluck of Abuja High Court.
It was thereafter he filed two separate motions before Honourable Justice C.M.A Olatoregun of the Federal High Court Lagos and Justice Candid Johnson of the Lagos High Court.
