Lekki Garden Collapsed Building: Absence of Magistrate stalls proceedings of MD & Contractors

Further proceedings in a suit filed against the Managing Director of Lekki Gardens, Mr. Robert Nyong, and the contractor that supervised the construction of the building, Mr. Taiwo Odofin, has been adjourned till September 30, 2016.

The new date was jointly agreed upon by the prosecutor, Barrister Goddy Osuyi, and lawyers to the accused persons, Mr. Bode Olanipekun and Mr. Uwangboje.
Both parties fixed the new date after the court's Registrars informed counsels and litigants of the indisposed of the court's new magistrate, Chief Magistate A. O. Awogboro (Miss)
Upon the information given by the court's Registrars, both the prosecution and the defence agreed on the new date, which was communicated to the Registrars.
It would be recalled the men of State Criminal Investigation and Intelligence Department (SCIID) of Lagos State Police Command, on March 11, brought both the  Managing Director and the contractor before the court formerly presided over by Magistate Afolashade Botoku, for remand, following the collapsed of a five-storey building in Lekki area of the state, which killed thirty five people, leaving many others injured.
In the remand application, the police had urged Magistrate Botoku led-court to remand the accused pending when it will complete it's Investigation on the matter.
Consequently, Chief Magistrate Botoku conceded to the police request, and adjourned the matter till March 23, while ordered that the two men be remanded in the SCIID's custody.
When the matter came up in March 23, the police failed to produce the two men before the court, the action which Chief Magistrate frowned at and ordered the police produce the accused persons before the court on the following day, which was March 24.
Upon the production of the two men in court by the police on the following day, Chief Magistrate Botoku graciously admitted them to bail, following bail applications filed by the lawyers to the accused persons.
In granting the bail applications, the Chief Magistrate admitted bail to the firm's Managing Director on self recognizance, while the contractor, was admitted to bail in the sum of ten million with two sureties.
Magistrate Botoku also ordered both Nyong and the contractor to be reporting at the SCIID, Panti-Yaba, between the hours of 10 a.m., and 5 p.m., everyday till the police complete their investigations. While also ordered that the two defendants should submit their international passports and are not permitted to travel out of the country till the matter is concluded.
The Chief Magistrate eventually adjourned the matter till April 12, but before the adjourned date, she has been transferred out of the court to a customary court.
The development which made the matter to be adjourned till today, June 30.
However, on arrival at court today, the court's Registrars informed both the counsels and litigants of the indisposition of the new presiding Chief Magistrate, Miss A. Awogboro, the development which made both parties to agreed on September 30.
A police source informed this medium that the DPP is yet to communicate to the police its advice on the matter.
