Electrician gets death penalty for stealing

Justice Kudirat Jose of a Lagos High court sitting in Ikeja has sentenced a thirty two-year- old electrician, Muyili Ahmed to death for guilty of armed robbery.
The presiding judge sentenced Ahmed to death on two count amended charged dated March 31,2014 bordering on conspiracy to commit armed robbery and unlawful possession of firearms brought against him by the state.
His offence of armed robbery contrary ‎to Section 295 (2)(a) and unlawful possession of firearms contrary to Section 328 of the Criminal Laws of Lagos State 2011.
The convict was said to have robbed a shop owner of N180,000 at gun point.
Muyili and others at large, had sometimes in July 2012 at Odongunyan  Ikorodu approached the complainant (names witheld) at around 9pm that they wanted to buy Mcdowell whiskey. She told them that she had closed for the night but they insisted on buying from her.
During trial, in her testimony before the court, said that while she was trying to get the drink, Muyili pointed a gun at her and demanded for money.
  "I willingly gave them 180,000, but Muyili and his gang demanded for more. I tried to escape and it was in the process that I broke my leg and also sustained serious injuries," she said.
The prosecution tendered two locally made single barrel pistol, four live catridge, one brownie pistol with no PM57932 and eight rounds of live ammunition.
Also, Muyili told court in his testimony that he trained as an electrical engineer admitted that he robbed the woman but that he collected N50,000 from her, and not N180,000 as she claimed.
"I carried out four robbery operations before this one. I only collected fifty thousand naira from her and not one hundred and eighty thousand naira," he said.
While the second defendant in the suit, Azeez Abass denied  partaking in the robbery that day.
Delivering judgement, Justice Jose pointed out that it was not how much that was collected but the motive of carrying out the crime.
"The 1st defendant (Muyili Ahmed) is hereby sentenced to death, while the 2nd defendant (Azeez Abass) is hereby discharged and acquitted because the prosecution could not prove that he was at the scene of the crime," she ruled.
